We received the following information from SSA today.
“Good news! The 2020 FPL table is now updated and available in POMS, HI 03001.020 in section C5 under the heading titled “Special Procedures when the annual Federal Poverty Level (FPL) table rates are unavailable
for subsidy determinations”.
To address your concern about our use of 2020 rates when processing Extra Help applications prior to the publishing of 2020 FPL rates in our POMS. Our experts shared the following information.
Applications may be:
• Denied if the resources exceed 2020 resource limits (usually announced by Health and Human Services (HHS) in November): in 2020, $14,610 for a single beneficiary and $29,160 for a couple (systems includes the
$1500 per person for burial expenses); or
• Awarded if the subsidy level is 135% or less using prior year’s FPL table rates.
If neither of the situations in the two prior bulleted items applies to the claimant, the application is placed in “Hold” status, pending receipt of the new FPL table.”
