CMS posted Notice of Imposition of Immediate Intermediate Sanctions (Suspension of Enrollment and Marketing) for Medicare Advantage-Prescription Drug and Prescription Drug Plan contract numbers: H2020, H2334, H3071, H5454, H6379 (CO),H6672, H8293, H9403, H9589, and S6946 (includes MT, ND, SD, UT & WY). The letter to Delaware Life (Clear Spring) is attached and posted here outlines the sanction reasons - https://www.cms.gov/files/document/dlicsanction01312020.pdf. CMs notes about 70,000 enrollees nationally in 40 states. ACL downloaded the Jan. 2020 enrollment by contract/plan/state/county to identify where in the country the enrollees live. The file is too large to download fully, so only enrollment counts for H2020, H2334, and H3071 are included in the attached .xls. Also included in the attached .xls are the specific, impacted plan names.

 

As with any plan complaints, SHIP, SMP, MIPPA team members should follow existing processes in contacting the plan, 1-800-Medicare, or using the Complaint tracking Module (CTM) to file complaints.
